Order of protection question?

so my daughters father has been in jail for a month now, due to violating an order of protection which was honestly unfair considering he didnt do ANYTHING to me...now, I went to his first court date because I was subpeaned but I expressed to the DA I do not fear him and i never requested an order of protection to begin with. I also let her know that he is an important part of our family, he is a great father, has a good job, and this situation is potentially destroying our family and lives, i requested that the order be dropped. Instead she offered him 3 years probation, a 52 week program and a 5 year order of protection...he refused this offer, and now im not sure exactly what my options are. He has court this monday and its on for non jury trial...him being incarcerated is destroying everything we worked so hard for and I know that I cannot get help from the DA. [we live in NY]...i havent received a subpeona for monday but i moved so maybe its at my prior address, now...can anyone help me get some clarity?
