What do I do with this tenant thatis refusing to leaving?

I gave a notice to my tenant that he will have to vacate the 1 bedroom he has rented in my upstairs apartment within 1 month, because I have family moving in. His immediate reaction was I am taking you to court & going to stay 3 to 6 months more. He then insisted if he doesn't find anything by January 1 he is not leaving. He is very problematic. He broke our verbal contract, we rented the room to him & he has his girlfriend living there, when we addressed this issue, he denies it. I spoke to a lawyer & today had a letter written by myself stating that I gave him a notice & we agreed he would leave by then & certified it, he will be receiving it tomorrow. Now my question is, how long would it take to get a court date? during this court time, he still has to pay me rent? What if he becomes violent? Thank You.
